Chou Rouge Creative – Terms & Conditions
1. The Booking Process
To secure your booking, please review our Terms & Conditions and complete the Booking & Agreement Form provided via email. Your e-signature is required to confirm a legally binding contract. Amendments to this contract may be made if agreed upon by both parties before the event commences. Any amendments must be documented, reissued, and signed, with associated payments completed before the event date.
Bookings are only confirmed upon receipt of the completed booking form and the holding deposit. Both must be submitted within seven (7) days of receiving the contract. Without these, your booking will not be secured.
2. Payment
A. Deposit & Balance Payments
A holding deposit is required to secure the booking.
The remaining balance must be cleared no later than thirty (30) days before the event. A final invoice, including any damage deposit, will be issued in advance.
B. Non-Payment
Failure to pay the remaining balance on time allows Chou Rouge Creative to terminate the contract without penalty to us, but the deposit will be retained as compensation. Cancellation fees may also apply (see Clause 5).
C. Late Deposit Payment
Deposits not received within seven (7) days of the booking agreement are deemed a breach of contract. Chou Rouge Creative will no longer be liable for the booking, and cancellation fees (Clause 5) may still apply.
D. Damage or Loss
If equipment cannot be collected or returned due to damage, loss, or theft, the client is liable for full replacement costs. This is in addition to the forfeiture of the damage deposit (Clause 7).
3. Hire Period
A. Standard Hire Period
A standard hire for weekend events spans five (5) days:
Collection: Thursday (time agreed upon at booking).
Return: Monday (time agreed upon at booking).
B. Extended Hire Periods
Non-standard hire periods are charged at £25 per additional day.
C. Midweek Events
For midweek bookings, collection and return dates are agreed upon in advance.
D. Delayed Returns
A £25 fee applies for delays over 30 minutes, unless notified at least 1 hour in advance.
A £50 fee applies for delays exceeding 1 hour, plus an additional £50 for every 24-hour delay thereafter.
4. Client Obligations
Equipment must only be used by the client or approved parties. Unauthorized use is prohibited.
Outdoor use of equipment is allowed only with prior consent. Equipment must be protected from adverse weather conditions (e.g., rain, snow, strong winds).
The client is responsible for any damage or loss, which may result in additional charges or legal action.
5. Cancellation Policy
A. Cooling-Off Period
Clients may cancel within fourteen (14) days of booking confirmation for a full refund of the deposit, provided no services or equipment have been rendered.
B. Cancellation Fees (after 14 days)
Cancellation fees apply based on the proximity of the event:
90+ days before the event: 50% of the remaining balance.
61-89 days before the event: 75% of the remaining balance.
60 days or fewer: 100% of the remaining balance.
All fees must be settled within fourteen (14) days of invoice issuance. Late payments may result in additional charges and referral to a debt recovery service.
6. Hire Items
All hired items must be returned in the supplied packaging. Missing or damaged packaging incurs a £10 charge per box.
Candles are not permitted unless cleared in advance. LED candles can be supplied upon request.
Bespoke signage or fragile items must be returned in proper protective packaging. Damaged items will be charged at replacement cost.
The client must use a suitable vehicle for transporting hired items. Guidance can be provided upon request.
Hired items must be packed in the provided boxes and left at a pre-agreed collection point. Failure to do so may result in a £100 fee for additional collection time.
7. Damage or Loss
Clients are responsible for the care of all hired materials throughout the hire period.
Damage deposits will be refunded within 5-10 working days post-event, provided all items are returned in acceptable condition. Unclaimed deposits after 12 months will be forfeited.
Damaged or lost items will be charged at replacement cost, deducted from the damage deposit or invoiced separately.
8. Substitution of Equipment
In rare cases, substitutions may be made if equipment is unavailable due to damage or fault. Substitutions will be of similar quality and value. This does not entitle the client to cancellation or compensation.
9. Force Majeure
Neither party shall be liable for failure to fulfill contractual obligations due to events beyond reasonable control, including but not limited to natural disasters, war, pandemics, or government orders. Deposits will be retained, but cancellation fees will be waived if Force Majeure is proven.
